CIRCULAR

ABOLITION OF SOME LEGAL DOCUMENTS ISSUED BY THE MINISTER OF PUBLIC SECURITY

Pursuant to the Law on Promulgation of Legal Documents dated June 22, 2015;

Pursuant to the Law amending and supplementing a number of articles of the Law on Promulgation of Legal Documents dated June 18, 2020;

Pursuant to Decree No. 34/2016/ND-CP dated May 14, 2016 of the Government detailing a number of articles and measures to implement the Law on Promulgation of Legal Documents ;

Pursuant to Decree No. 154/2020/ND-CP dated December 31, 2020 of the Government amending and supplementing a number of articles of Decree No. 34/2016/ND-CP dated May 14, 2016 of the Government detailing a number of articles and measures to implement the Law on Promulgation of Legal Documents ;

Pursuant to Decree No. 59/2024/ND-CP dated May 25, 2024 of the Government amending and supplementing a number of articles of Decree No. 34/2016/ND-CP dated May 14, 2016 of the Government detailing a number of articles and measures for implementing the Law on Promulgation of Legal Documents , which has been amended and supplemented a number of articles under Decree No. 154/2020/ND-CP dated December 31, 2020 of the Government;

Pursuant to Decree No. 01/2018/ND-CP dated August 6, 2018 of the Government stipulating the functions, tasks, powers and organizational structure of the Ministry of Public Security;

Pursuant to Decree No. 05/2024/ND-CP dated November 11, 2024 of the Government amending and supplementing a number of articles of Decree No. 01/2018/ND-CP dated August 6, 2018 of the Government stipulating the functions, tasks, powers and organizational structure of the Ministry of Public Security;

At the request of the Director of the Department of Legislation and Administrative and Judicial Reform;

The Minister of Public Security issued a Circular to abolish a number of legal documents issued by the Minister of Public Security.

Article 1. Abolish all legal documents issued by the Minister of Public Security

Abolish all legal documents issued by the Minister of Public Security as follows:

  1. Circular No. 09/TT-BNV(X11) dated December 12, 1995 of the Minister of Home Affairs regulating the payment regime for overtime teaching.
  2. Circular No. 09/2004/TT-BCA(V19) dated June 16, 2004 of the Minister of Public Security guiding the application of a number of measures to protect whistleblowers, witnesses and victims in drug cases.
  3. Circular No. 41/2009/TT-BCA-V19 dated July 2, 2009 of the Minister of Public Security supplements Circular No. 12/2004/TT-BCA(V19) dated September 23, 2004 of the Minister of Public Security guiding the implementation of a number of provisions of the 2004 Ordinance on Organization of Criminal Investigation in the People’s Public Security.
  4. Circular No. 51/2012/TT-BCA dated August 10, 2012 of the Minister of Public Security regulating the political theory study regime in the People’s Public Security.
  5. Circular No. 41/2014/TT-BCA dated September 24, 2014 of the Minister of Public Security regulating the management of officers, non-commissioned officers, workers and civil servants in the People’s Public Security.
  6. Circular No. 55/2017/TT-BCA dated November 16, 2017 of the Minister of Public Security stipulating measures to implement the financial autonomy mechanism of public service units in the People’s Public Security.
  7. Circular No. 04/2020/TT-BCA dated January 10, 2020 of the Minister of Public Security stipulating equivalent positions in the People’s Public Security.
  8. Decision No. 1103/2000/QD-BCA (E17) dated December 7, 2000 of the Minister of Public Security promulgating Regulations on production, storage, preservation, transportation, distribution, use, and destruction of CS and pepper sprays containing CS as support tools of the People’s Public Security force.
  9. Decision No. 767/2002/QD-BCA dated August 21, 2002 of the Minister of Public Security on promulgating forms for use in registering product quality and manufacturing technical means and support tools.

Article 2. Partial repeal of legal documents issued by the Minister of Public Security

Abolish the phrase “with confirmation from the police of the commune, ward or town where the stateless person is temporarily residing” in Point b, Clause 2, Article 5 and Point c, Clause 1, Article 7 of Circular No. 31/2015/TT-BCA dated July 6, 2015 of the Minister of Public Security guiding a number of contents on visa issuance, temporary residence card issuance, entry and exit permits issuance, and permanent residence settlement for foreigners in Vietnam.

Article 4. Implementation

  1. This Circular takes effect from January 16, 2025.
  2. The Director of the Department of Legislation and Administrative and Judicial Reform, Heads of units under the Ministry, Directors of Public Security of provinces and centrally-run cities and relevant agencies, organizations and individuals are responsible for implementing this Circular./.
