Exclusive Trademark Registration at Vietnam

An enterprise trademark is a symbol for consumers to recognize an enterprise in the market. In the long-term perspective, it is recommended that enterprises should always register trademark/brand protection to prevent fraudulent in the faking of products, which leads to a big impact on the enterprise’s reputation

1. The trademark is a symbol to distinguish the products and services of different individual enterprises. Besides individual trademarks, there are Group trademarks, Registration trademarks, and Connection trademarks.
2. A popular Trademark is defined as a trademark that is commonly known by all citizens in Vietnam territory.

1. Law on Intellectual Property 2005.
2. Decision 65/2023/NĐ-CP orient Law on Intellectual Property 2005.

Application, procedure:
Application for industry ownership includes:

1. Registration form (follow samples);
2. Documents, samples, and information relevant to the subject registered by the enterprise (for trademark, a sample file is requested, about 3 -8cm in length in jpeg. If the applicant wants to register for a colored one, 10 designed samples with colored are requested);
3. Authorization form (follow authorization form -An Luật Việt Nam);
4. Document proving the right to register (in case the application is the beneficiary of this right from another person);
5. Document prove priority rights (in case request for priority right is requested);
6. Invoice for fees

Submitted to: Intellectual Property Office of Viet Nam.

Timeline for procedure:

1. Application evaluation: 1 month starting from the submitted day.
2. Industry ownership notification: The second month counts from the approval day.
3. Ownership evaluation months starting from the notification date.
4. Total: Estimate more than 12 months.

Some valuable sharing:
Besides registration for name and logo, the enterprise can also register:

1. Product name: The name of the product (counted as trademark registration) as well as the label, card, and model of the product.
2. Industry appearance: The outside appearance of the product (must be different from other products)
3. Pattern registration: Technician design or product formula

Enterprises can also register for trademark protection in foreign countries through the MADRID procedure.“Madrid application” is a trademark registration following the Madrid treaty.
