CIRCULAR

AMENDING AND SUPPLEMENTING A NUMBER OF ARTICLES OF CIRCULAR NO. 04/2015/TT-BCA DATED JANUARY 5, 2015 OF THE MINISTRY OF PUBLIC SECURITY

Stipulating the Forms of Documents Related to the Entry, Exit, and Residence of Foreigners in Vietnam

Pursuant to the Law on Entry, Exit, Transit and Residence of Foreigners in Vietnam dated June 16, 2014 and the Law amending and supplementing a number of articles of the Law on Entry, Exit, Transit and Residence of Foreigners in Vietnam dated November 25, 2019;

Pursuant to Decree No. 01/2018/ND-CP dated August 6, 2018 of the Government stipulating the functions, tasks, powers and organizational structure of the Ministry of Public Security;

At the request of the Director of the Immigration Department;

The Minister of Public Security issued a Circular amending and supplementing a number of articles of Circular No. 04/2015/TT-BCA stipulating forms of documents related to entry, exit and residence of foreigners in Vietnam.

Article 1. Amending and supplementing a number of articles of Circular No. 04/2015/TT-BCA dated January 5, 2015 of the Ministry of Public Security stipulating forms of documents related to entry, exit and residence of foreigners in Vietnam.

  1. Amendments and supplements Clause 1 Article 1 as follows:

“1. This Circular stipulates, guides the use and management of types of documents related to the entry, exit and residence of foreigners in Vietnam according to the provisions of the Law on Entry, Exit, Transit and Residence of Foreigners in Vietnam and the Law amending and supplementing a number of articles of the Law on Entry, Exit, Transit and Residence of Foreigners in Vietnam ” .

  1. Add some clauses of Article 2 as follows:
  2. a) Add clause 1a after paragraph 1 as follows:

“ 1a. Information on application for electronic visa Download Form_NA1a_572020”.

  1. b) Add clauses 19 and 20 below. paragraph 18 as follows:

“19. Application for electronic account issuance Download Form_NA19_572020.

  1. Request for cancellation of electronic account Download Form_NA20_572020”.
  2. Add clauses 3a, 3b and 3c below. Clause 3 Article 3 as follows:

“ 3a. Official dispatch in response to request for electronic account issuance Download Form_NB8_572020.

3b. Official dispatch notifying refusal to issue electronic account Download Form_NB9_572020.

3c. Official dispatch notifying of cancellation of electronic account Download Form_NB10_572020.

  1. Add clauses 2a and 2b below. paragraph 2 and items 14 and 15 come later. Clause 13 Article 4 as follows:

“ 2a. Electronic visa (NC2a).

2b. Visa according to the personnel review list of the immigration authority (NC2b).

  1. Sample of invalidation stamp (NC17).
  2. The seal sample has expired (NC18).
  3. Modifications Point a, Clause 1, Article 5 as follows:

“a) The Immigration Department is responsible for contracting with the Institute of Science and Technology – Ministry of Public Security to research, design, and produce white publications to promptly meet the requirements of competent authorities to issue visas, temporary residence cards, permanent residence cards, and visa exemption certificates.”.

  1. Replace the phrase “January 29, 2012” with the phrase “January 29, 2002”, the phrase “Circular No. 02/2012/TT-BCA” with the phrase “Circular No. 02/2013/TT-BCA” and the phrase “Circular No. 25/2013/TT-BCA” with the phrase “Circular No. 25/2014/TT-BCA” at Clause 1, Article 6 .

Article 2. Effectiveness and responsibility for implementation

  1. This Circular takes effect from July 1, 2020.
  2. The Immigration Department is responsible for presiding over and coordinating with the Public Security of units, localities and other relevant units to organize the implementation, guide and inspect the implementation of this Circular. Heads of units under the Ministry, Directors of Public Security of provinces and centrally run cities are responsible for implementing this Circular. In the course of implementation, if there are any problems, the Public Security of units and localities shall report to the Ministry (through the Immigration Department) for timely guidance./.
